Terms + Conditions FOR ALL USED EQUIPMENT SALES

CONDITIONS OF SALE

Acceptance: All proposals and acceptances of orders are made with the mutual understanding that orders are not subject to cancellation.

Terms: Full payment by cash, bank wire or check with order prior to shipment unless otherwise arranged. Title to goods does not pass to buyer until payment is received in full. Quoted price does not include taxes and taxes will be added where applicable. Any clauses in buyers purchase order which are contrary to these terms and conditions shall be null and void upon buyers acceptance of this proposal. Quotations are subject to change without notice. We reserve the right to correct all typographical errors.

Warranty: The goods described herein are preowned used goods and otherwise noted herein. Seller makes no warranties of any kind of merchantability and fitness for a particular purpose. All specifications and descriptions of said goods are approximate only. It is the buyer’s responsibility to inspect the goods and determine if the specifications, descriptions, and condition of the goods conform to buyer’s requirements.

Machine Use and Safety: Buyer acknowledges that the goods described herein are preowned used goods which were neither designed nor manufactured by the seller, nor has the seller knowledge of, or control over, the prior use or misuse of said goods, nor does the seller have knowledge or control over the future application of these goods by the buyer. It is the buyer’s (user’s) responsibility to provide proper safety devices, equipment and instructions for any particular use and to take all necessary steps to conform to all federal, state or local government safety standards and including OSHA.

Indemnification: Purchaser hereby agrees to defend, indemnify and hold harmless Seller its directors, officers, employees and other agents and representatives from and against any and all liabilities, judgments, claims, settlements, losses, damages, penalties, obligations and expenses, including attorney’s fees and expenses and other professional fees and expenses, incurred or suffered by such person arising from, by reason of, or in connection with any loss, damage or injury to person or property arising from, by reason of or in connection with the Goods sold hereunder. This indemnification shall survive delivery of the Goods to Purchaser and any subsequent sale or other transfer of the Goods to a third party.

Return Privilege: All items are sold “As Is” with no return privilege unless otherwise arranged. In that these goods are used Buyer’s Terms and Conditions do not apply and by completing the transaction buyer agrees to the above.
